Australian Immigration Backs National Fair Work Campaign

The nationwide campaign by the Fair Work Ombudsman has been backed by the Australian Department of Immigration and Citizenship (DIAC) in order to educate employers in the agricultural industry of its responsibility towards the workers who have migrated.

One of the authorized personnel for DIAC stated that Australian visa holders “represent a significant proportion of the harvest workforce for a wide variety of crops” and it is for this reason that it was extremely important that the employers were informed and made conscious about the requirements of immigration. Some time back the Govt. introduced a new legislation to shield the foreign workers from being taken advantage of by the employers.

Very often it had been noticed that the employers preferred to employ the foreign workers at very cheap rates in comparison to the local workforce and that is the time when the DIAC announced that it would be coordinating with the Fair Work Ombudsman, and the taxation office of Australia and even some of the health and safety agencies to make sure that the foreign employees got their due and were saved from being exploited. The legislation was aimed at all categories of workers, be it the immigrant workers or the locals, to get their due in tandem with the Australian workplace laws.

Although the DIAC hopes to get the task of making sure this information and message is known by all employers yet this is a difficult task and needs a collaborated effort from the agricultural industry and the immigration outreach officers. This new initiative which has been pioneered by the Fair Work Ombudsman is going to make sure that the relevant message is spread across in a manner which will make employers and employees of the agricultural sector aware of the repercussions of any breach of these laws.

The department is completely focused on making sure that the migration and visa programs are processed with integrity and do not have any kind of breach involved. The new legislation has rules which would fine the employers who are found guilty of breaching the laws. For the convenience of the employers and for them to be able to easily verify the visa status of their employees the VEVO program has been launched. The VEVO program is the Visa Entitlement Verification Online, which helps the employer to be able to check the details of their employees.

Once the worker consents on being verified the employer has the facility of being able to verify the details of the worker through the VEVO services. Any person found guilty of not being present with the right kind of documentation and permission to be working in the country is liable to be fined approximately $13000 and will also be put behind bars for duration of two years and if the employers are caught employing foreign workers illegally then they would be fined around $66,000 per illegal worker found employed.

It is expected that the new stringent laws would refrain the employers from taking advantage of employees and also refrain illegal employees from working and thereby bring about lawful implementation of employment laws.
